1. Company Overview

Field Seminar LLC ("Field Seminar," "we," "us," or "our") is a travel services company that organizes curated group travel experiences combining leisure travel with informal intellectual programming. Field Seminar is organized under the laws of the United States and operates as a limited liability company.

2. Not an Educational Institution

Field Seminar is not an accredited educational institution and is not credentialed or authorized to grant academic credit, degrees, diplomas, certifications, or continuing education units of any kind. All references to "seminars," "faculty," "lecturers," "reading lists," or similar academic terminology are used colloquially to describe our travel programming and should not be interpreted as representing formal education.

Participation in any Field Seminar journey does not constitute enrollment in an academic program and confers no educational credentials. Any experts, speakers, or discussion leaders engaged by Field Seminar participate in their personal capacity and do not represent any academic institution.

3. Booking and Payment

3.1 Application and Acceptance

All Field Seminar journeys require a completed application. Submission of an application does not guarantee acceptance. Field Seminar reserves the right to accept or decline any application at its sole discretion. A booking is confirmed only upon written acceptance by Field Seminar and receipt of the required deposit.

3.2 Deposit and Final Payment

A non-refundable deposit of 25% of the total journey cost is due 60 days prior to the departure date. The remaining balance is due no later than 30 days prior to the departure date. If full payment is not received by the due date, Field Seminar reserves the right to cancel the booking and retain the deposit.

3.3 Pricing

All prices are quoted in U.S. dollars unless otherwise stated. Prices are subject to change until a booking is confirmed in writing. Published prices include accommodations, meals, activities, and ground transportation as described in the specific journey itinerary. Airfare to and from the journey destination is not included unless explicitly stated.

4. Cancellation and Refund Policy

4.1 Cancellation by Participant

All cancellation requests must be submitted in writing. The following schedule applies:

  • 30 to 60 days before departure: Full refund less the non-refundable deposit
  • 15 to 29 days before departure: 50% of the total journey cost refunded
  • 7 to 14 days before departure: 25% of the total journey cost refunded
  • Less than 7 days before departure: No refund

4.2 Cancellation by Field Seminar

Field Seminar reserves the right to cancel any journey at any time for any reason, including but not limited to insufficient enrollment, safety concerns, or force majeure events. In the event of cancellation by Field Seminar, participants will receive a full refund of all payments made. Field Seminar's liability in such cases is limited to the refund of payments received and does not extend to any additional costs incurred by the participant, including but not limited to airfare, travel insurance, visa fees, or other preparatory expenses.

5. Health, Fitness, and Assumption of Risk

5.1 Physical Requirements

Field Seminar journeys may involve physical activities including but not limited to walking on uneven terrain, boarding vehicles and watercraft, exposure to heat and sun, altitude, wildlife encounters, and travel in areas with limited medical infrastructure. Participants are responsible for accurately assessing their own physical fitness and health status before booking.

5.2 Medical Disclosure

Participants must disclose all relevant medical conditions, physical limitations, allergies, dietary restrictions, and medication requirements at the time of application. Failure to disclose material health information may result in removal from the journey without refund. Field Seminar reserves the right to require a physician's clearance for participation at any time.

5.3 Participants of Advanced Age

Field Seminar welcomes participants of all ages, including older adults. However, participants acknowledge that travel, particularly to remote or developing regions, involves inherent physical demands and health risks that may be heightened for individuals of advanced age or those with pre-existing medical conditions. Field Seminar does not provide medical care, nursing assistance, or personal care services. Participants requiring such services must arrange them independently at their own expense.

5.4 Assumption of Risk

By booking a journey, participants acknowledge and accept the inherent risks of travel, including but not limited to: illness, injury, or death; exposure to communicable diseases; accident or damage during transportation; political instability; natural disasters; wildlife encounters; crime; and the negligence of third-party service providers. Participants voluntarily assume all such risks and agree that Field Seminar shall not be held liable for any loss, damage, injury, or death arising from these risks.

6. Limitation of Liability

6.1 Third-Party Services

Field Seminar acts solely as an organizer and intermediary for travel services provided by independent third parties, including but not limited to airlines, hotels, lodges, safari operators, boat operators, ground transportation providers, restaurants, and activity providers. Field Seminar does not own, operate, manage, or control any of these third-party services and assumes no liability for any act, omission, negligence, default, injury, loss, damage, delay, or irregularity arising from the provision of such services.

6.2 Limitation of Damages

To the maximum extent permitted by law, Field Seminar LLC, its owners, officers, employees, agents, contractors, and affiliates shall not be liable for any indirect, incidental, consequential, special, or punitive damages, including but not limited to loss of enjoyment, emotional distress, lost wages, or loss of opportunity, arising from or related to any journey, regardless of the cause of action.

6.3 Maximum Liability

In no event shall Field Seminar's total aggregate liability to any participant exceed the total amount paid by that participant for the specific journey giving rise to the claim.

6.4 Indemnification

Participants agree to indemnify, defend, and hold harmless Field Seminar LLC, its owners, officers, employees, agents, and affiliates from and against any and all claims, liabilities, damages, losses, costs, and expenses (including reasonable attorneys' fees) arising from or related to the participant's actions, omissions, health conditions, failure to comply with these terms, or violation of applicable law.

7. Travel Insurance

All participants are required to purchase comprehensive travel medical insurance covering emergency medical expenses, emergency evacuation, and repatriation prior to departure. Proof of coverage must be provided to Field Seminar no later than 30 days before the departure date. Failure to provide proof of adequate travel medical insurance may result in removal from the journey without refund. Field Seminar additionally recommends that participants purchase trip cancellation and trip interruption coverage. Field Seminar is not responsible for any costs arising from a participant's failure to obtain adequate insurance.

8. Travel Documents and Compliance

Participants are solely responsible for obtaining and maintaining valid passports, visas, vaccinations, and any other documentation required for travel. Field Seminar is not liable for any loss, delay, or expense resulting from a participant's failure to comply with entry, exit, health, or other requirements of any country.

9. Itinerary Changes

Field Seminar reserves the right to modify any itinerary, accommodations, or activities at any time before or during a journey due to weather, safety concerns, logistical considerations, availability, or any other reason deemed necessary by Field Seminar or its local partners. Such modifications do not constitute grounds for a refund unless the journey is materially altered in a way that renders it fundamentally different from what was described at the time of booking.

10. Conduct and Removal

Field Seminar reserves the right to remove any participant from a journey, at any time and without refund, if their behavior is deemed disruptive, dangerous, or detrimental to the safety, well-being, or enjoyment of other participants or staff. This determination is made at the sole discretion of Field Seminar's journey leaders.

11. Force Majeure

Field Seminar shall not be liable for any failure or delay in performing its obligations where such failure or delay results from circumstances beyond its reasonable control, including but not limited to natural disasters, pandemics, epidemics, government actions, war, terrorism, civil unrest, strikes, transportation disruptions, or acts of God.

12. Intellectual Property and Media

All content on the Field Seminar website, including text, images, design, and branding, is the property of Field Seminar LLC and may not be reproduced without written permission. By participating in a journey, participants grant Field Seminar a non-exclusive, royalty-free, perpetual license to use photographs, video, and testimonials from the journey for marketing and promotional purposes, unless the participant opts out in writing prior to departure.

13. Privacy

Personal information collected during the application and booking process is used solely for the purpose of administering your journey and communicating with you about Field Seminar offerings. We do not sell or share personal information with unaffiliated third parties for their marketing purposes. For more details, please see our Privacy Policy.

14. Dispute Resolution

Any dispute arising from or relating to these terms or any Field Seminar journey shall be resolved through binding arbitration administered in accordance with the rules of the American Arbitration Association. The arbitration shall take place in the state in which Field Seminar LLC is registered. Participants waive the right to participate in any class action lawsuit or class-wide arbitration against Field Seminar.

15. Governing Law

These terms shall be governed by and construed in accordance with the laws of the United States and the state in which Field Seminar LLC is registered, without regard to conflict of law principles.

16. Severability

If any provision of these terms is found to be invalid or unenforceable, the remaining provisions shall continue in full force and effect.

17. Entire Agreement

These Terms of Service, together with any journey-specific documentation provided at the time of booking, constitute the entire agreement between the participant and Field Seminar LLC and supersede all prior communications, representations, and agreements, whether written or oral.
